On December 28, 2009 around 5:30 p.m., we came by this house to check the outside and see how clean it was but it was already dark, so we couldn¡¯t see without electricity.  There was a lot of water on the patio and the house door was unlocked.      

On December 29, 2009 we moved in 2800 Plaza Del Amo, Unit *** Torrance CA.  Once we arrived at this location our realtor was cleaning the house because it was very dirty.  The carpet was still wet and dirty with dust at the edges and every corner of rooms and stairs.  The stop hand rail was broken from second floor to third floor.  The windows were very dirty and window rail had a lot of dirt.  The bottom lock of the main door does not lock properly.  The sliding door lock in the living room was broken.  One towel hanger was broken and one bent.  Every single blind was very dusty and dirty.  The panel above the hanger in the walk-in closet was not there.  One piece of blind in the bedroom is broken.  Panel above the blind in the master bedroom was missing.  Inside of the refrigerator was very dirty with mold and dirty liquid plus there is no light.  The stove was dirty and the brackets of the stove are still very dirty with stinky liquid.  The oven is also very dirty it looked like it has not been clean for a long time.  The microwave was also dirty and didn¡¯t have the microwave glass plate it only had the dirty metal grill.  Under the microwave there is no filter for the fan when you cook.  All the cabinets and pantry were very dirty the kitchen counters had sticky dirt.  When you touch most of the cabinet doors they are sticky.  The light in the kitchen ceiling was dirty and sticky.  The panel on the top of the blind is broken in the kitchen.  The heater fan area had a lot of dirt.  All the walls of the house have black marks of hand prints and foot prints.  On every bathroom there is urine on the walls.  There was a shower curtain still hanging from the last tenant who used to live here.  The patio was not clean.  In the garage there is still garbage from the previous tenants.  There were a lot of dust balls in the garage and the laundry area.  All these problems, my brother and my wife took pictures and had to put on the inspection paper.   

Because of the above problems once we got to this residence our mover said the house is very dirty and we lost time trying to get a hold of the landlord plus we waited a lot of time and finally we decided to leave our house hold goods in the dirty garage.  The reason why our stuff stayed in the garage was because the movers were charging us $100 per hour.  Our realtor talked to the landlord and he came to an agreement that we pay the cleaning company and we can deduct the amount for next payment of rent.  The first time the landlord did not approved on getting this house clean but once my realtor showed pictures and inspection paper of the problems then the landlord approved.  I thought the landlord was supposed to give us the inspection papers first.  My realtor request the cleaning company and then we had to move out of this house for that night.  By this time the landlord still didn¡¯t know the conditions of this house. We took only a few blankets and stayed the night at our old place.  So my wife, two years-old daughter and my two brothers that came to help me had to sleep on the floor at an empty former house.  The next day 30th of December the cleaning company clean this house and we had to pay $250.  The carpet was still very dirty and little wet.  The sliding door was still not fixed yet and we had to sleep without safety security in this house.

31st December, we complained for the security problem and the rest of the problems to the landlord.  The landlord agreed to only pay $100 for fixing the security and the rest of the problems.  The handyman only fixed three things which was the sliding door lock, the stop hand rail and the towel hanger and charged $100.    My wife was very upset so she called the landlord directly and when she started complaining he hanged up on her.  Then I called the landlord and then he came to this unit.  He didn¡¯t even know about the problems in this house.  He kept saying to us that this house is in excellent conditions.  Everything wrong that we showed him he would reply by saying is a minor problem.  He also told us ¡°move out I¡¯ll be happy but you should know I have your security deposit $3500.¡± The landlord said ¡°If I accept your complain now you will complain more and more.¡± We requested what he supposed to do before we move in this house, this is not complaint.  A few minutes later he allowed the handyman to fix a few more things but he didn¡¯t want to paint the walls and he told my realtor from now, any other problem the tenants have to pay for anything that needs to get fixed.  The landlord still doesn¡¯t want to fix the broken blind and the missing panel in the bedroom.  When my realtor showed the pictures to the landlord and she asked about a missing glass plate in the microwave, the landlord wants us to wait until he finds any used one.  We just moved to this house and why do we need to clean urine on the walls on every bathroom, take off prints on the walls and pay to get things fixed?  The landlord said he had an invoice from somebody cleaning the carpet, I wonder how somebody can clean the carpet when there is no electricity in the house.  We can¡¯t even vacuum clean without electricity.

When we first saw this house in November the house had dirty carpet and dirty walls so we didn¡¯t want to make a contract for this house.  Then the landlord promised my realtor that he will clean this house very well.  We wanted to negotiate $2,100 without appliance for two years but he suggested $2,150 with appliance.  The landlord said the tenant before us will leave the washer, dryer and the refrigerator so you can use them. The washer and dryer were very nice, almost brand new so we took his suggestion.  But once we got here we he switched already with old washer and dryer without notice.  When the landlord came on 31st December we complained why did you switch washer and dryer and he said is there any meant you can use nice LG washer and dryer on the contract?  We were shocked!  If it is clean very well this would be a good house that is why we made the contract.  But, once we got to this house we were very disappointed.  We lost our time, we slept on the floor, and we had to spend more money by eating outside.  We have had very uncomfortable and frustrated time since 29 December 2009.  We had a sad end of year and new year.

I want my money back first rent and security deposit because I don¡¯t want my family to live in this living conditions.
